These Terms of Use govern your access to and use of the Open Access Care website and any related online services or communications (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Open Access Care may change these Terms at any time, with or without notice. Your continued use of the Site after changes are posted means you accept the updated Terms.


1) About Open Access Care

Open Access Care (“Open Access Care,” “we,” “us,” or “our”) provides healthcare services and related information. The Site is intended to provide general information about our clinic, services, and ways to contact us.


2) No medical advice and no doctor–patient relationship

Information on this Site is provided for general informational purposes only. It is not medical advice and is not a substitute for professional diagnosis, treatment, or guidance from a qualified healthcare provider.

Using this Site, submitting a form, sending an email, or leaving a voicemail does not create a provider–patient relationship. A provider–patient relationship is established only through appropriate registration and clinical intake, and after Open Access Care agrees to provide care.

Never disregard professional medical advice or delay seeking it because of something you read on this Site.

If you believe you may have a medical emergency, call 911 (in the United States) or your local emergency number immediately.


3) Communications through the Site

The Site may offer ways to communicate with our staff, including email, forms, appointment requests, and other features.

You agree:

  • Not to submit unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable content.
  • Not to upload or transmit malware, viruses, or any code designed to disrupt, damage, or gain unauthorized access to systems or data.
  • Not to attempt to probe, scan, or test the vulnerability of any system or network.

We may limit or terminate access to Site features at any time, for any reason, including suspected misuse.


4) Email, forms, and electronic communications are not fully secure

Email, web forms, and standard electronic communications are not always secure. They may be intercepted, misdirected, or accessed by unauthorized parties.

By contacting us through the Site (including forms and email), you acknowledge and accept these risks and are responsible for deciding what information you choose to send. Avoid sending highly sensitive information through email or web forms when possible. For sensitive matters, contact our office by phone.

We discourage using public computers or public Wi-Fi to access services that may involve personal information.


5) Text messages (SMS)

If you provide your mobile phone number, you may receive text messages related to your care or your interactions with Open Access Care, such as appointment reminders, scheduling updates, and operational notifications you request.

Message and data rates may apply. Text messaging is not a fully secure form of communication and discretion should be used.

You can opt out at any time by replying STOP to any message, or by contacting our office directly. Opting out of texts will not affect the quality of care you receive, but it may limit how quickly we can send certain reminders.


6) Call recordings

Phone calls with Open Access Care may be recorded for training, quality assurance, and operational purposes where permitted by law. We take reasonable steps to secure recordings and limit access to authorized personnel.


7) Website content, accuracy, and availability

We try to keep information on the Site accurate and up to date, but content may contain errors, omissions, or outdated information. The Site and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or free of harmful components.


8) Limitation of liability

To the fullest extent permitted by law, Open Access Care will not be liable for any damages arising out of or related to your use of (or inability to use) the Site, including direct, indirect, incidental, special, consequential, exemplary, or punitive damages, even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.


9) Permitted use and restrictions

Open Access Care grants you a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

You may not:

  • Modify, copy, reproduce, distribute, publish, transmit, display, perform, or create derivative works from the Site or its content except as permitted by law.
  • Reverse engineer, decompile, disassemble, or attempt to discover source code or underlying ideas of the Site (except where prohibited by law).
  • Use the Site in a way that could disable, overburden, damage, or impair it.
  • Misrepresent an affiliation with Open Access Care or imply endorsement without written consent.

10) Intellectual property

All Site content, including text, graphics, logos, designs, photos, videos, and layout, is owned by or licensed to Open Access Care and is protected by applicable intellectual property laws.

Trademarks, logos, and service marks displayed on the Site are the property of Open Access Care or their respective owners. Nothing in these Terms grants you any rights to use them without prior written permission.


11) Third-party links and services

The Site may include links to third-party websites or services. We do not control third-party sites and are not responsible for their content, availability, or privacy practices. Your use of third-party sites is at your own risk, and you should review their terms and privacy policies.


12) Patient portals and third-party platforms

Open Access Care may provide access to third-party platforms used for scheduling, patient intake, billing, secure messaging, or other services. Those services may be governed by separate terms and privacy policies from the vendor. Use of those platforms may require additional agreements.


13) Payments and billing (if offered online)

If the Site allows you to submit payments or payment information, you agree to provide accurate billing information and authorize charges as applicable. Payment processing may be handled by third-party processors, and your payment details may be subject to their terms and privacy practices.

Open Access Care may change accepted payment methods, pricing, and payment workflows at any time.
